Overview

These SMS Terms & Conditions (“SMS Terms”) govern your participation in the Omsita text messaging program (the “Program”) operated by Omsita (“we,” “us,” “our”) and our brand experiences, including Triberine and TheVi Lab. By opting in to the Program, you agree to these SMS Terms and to our Privacy Policy. If you do not agree, do not opt in to the Program.

Program description

The Program delivers recurring automated text messages from Omsita to mobile numbers that have opted in. Messages fall into two categories:
  • Marketing messages: product launches from Triberine and TheVi Lab, promotions, restock alerts, abandoned cart reminders, exclusive offers, and brand news.
  • Transactional messages: order confirmations, shipping and tracking updates, delivery notifications, customer support replies, and account alerts (including two-factor authentication codes).
Messages are delivered via short code, 10-digit long code (10DLC), or toll-free number, depending on the brand and use case. The number from which messages originate will be disclosed at the time of opt-in. By opting in, you expressly consent to receive recurring automated marketing and transactional text messages from Omsita at the mobile number you provided, sent using an automatic telephone dialing system or similar technology. Consent is not a condition of purchase. You are not required to opt in to the Program to buy any product or use any Omsita service. You may opt in through any of the following methods:
  • Checking the SMS consent box and submitting your mobile number on one of our websites (for example, at checkout, in a popup, or via a signup form).
  • Texting a keyword such as JOIN or START to our Program number published on each brand site.
You must be at least 18 years of age (or the age of majority in your jurisdiction) to opt in. By opting in, you confirm that you are the account holder of the mobile number provided, or that you have authorization from the account holder.

Message frequency

Marketing message frequency is recurring and varies by brand — typically up to 10 messages per month. Transactional messages are sent as needed based on your account activity (for example, when you place an order). Frequency may increase during major launches, holiday seasons, or live promotional events.

Costs and carrier charges

Omsita does not charge a fee for participating in the Program. Message and data rates may apply in accordance with your mobile carrier’s plan. Contact your wireless carrier for details on charges that may appear on your bill. Omsita is not responsible for any charges imposed by your carrier.

Opt-out and help

You can opt out of the Program at any time, at no cost, by any of the following methods:
  • Reply STOP to any message you receive from us. We will send one final confirmation message, after which you will receive no further marketing texts.
  • Replies of UNSUBSCRIBE, CANCEL, END, or QUIT are honored the same as STOP.
  • Email support@omsita.com requesting removal.
For assistance, reply HELP to any message or email support@omsita.com. Our HELP auto-reply provides our brand name, support contact, and a link to these SMS Terms. To re-subscribe after a previous opt-out, reply START or UNSTOP, or opt in again via one of the methods described above. Opting out of marketing SMS does not stop transactional messages required to fulfill an active order (for example, shipping notifications). To stop transactional messages, you must cancel the underlying order or close your account.

Supported carriers

The Program is available on most major U.S. carriers, including AT&T, Verizon Wireless, T-Mobile, U.S. Cellular, Cricket, MetroPCS, Boost Mobile, Google Fi, and others. Carriers are not liable for delayed or undelivered messages. Service availability and message delivery are not guaranteed and may depend on network conditions outside our control.

Privacy and mobile information

Your phone number and SMS opt-in information are handled in accordance with our Privacy Policy. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the stated categories in our Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. In plain terms: your phone number and your SMS opt-in status are used only by Omsita (and the SMS platform that delivers messages on our behalf, acting as our service provider) to send you the messages you signed up for. We do not sell, rent, lease, or share your number with affiliates, partners, advertisers, or any other third party for their own marketing.

Accuracy of information; number changes

You are responsible for providing accurate, current, and complete information at opt-in, and for promptly notifying us if your mobile number changes or is no longer in your possession. If you no longer use the mobile number on file, you must opt out and re-subscribe with your new number. Omsita is not responsible for messages received by subsequent users of a recycled or reassigned number.

Prohibited use

You agree not to use the Program to:
  • Provide a phone number that is not your own or that you are not authorized to enroll.
  • Attempt to disrupt, overload, or interfere with the Program’s delivery infrastructure.
  • Send abusive, harassing, defamatory, fraudulent, or unlawful content in replies.
  • Resell, redistribute, or commercially exploit messages received from the Program.
We reserve the right to suspend or terminate your participation in the Program for any violation of these SMS Terms or for any reason, at our sole discretion, without notice.

Disclaimers and limitation of liability

The Program is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Omsita disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Omsita is not liable for: (a) any delayed, undelivered, or misdirected messages; (b) costs charged by your mobile carrier; (c) any actions or inactions of mobile carriers; (d) any damages arising from your participation in or inability to participate in the Program. In no event shall our aggregate liability arising from the Program exceed one hundred U.S. dollars (US$100).

Changes to these SMS Terms

We may update these SMS Terms from time to time to reflect changes in the Program, legal requirements, or carrier obligations. The “Last updated” date at the top of this page reflects the most recent version. Material changes will be communicated via SMS notice, email, or a prominent notice on omsita.com before they take effect. Your continued participation in the Program after the effective date of any change constitutes acceptance of the revised SMS Terms.

Governing law

These SMS Terms are governed by the laws of the United States and the State in which Omsita’s headquarters is registered, without regard to conflict-of-laws principles. Compliance is maintained with the U.S. Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles and Best Practices, and applicable carrier policies. Any dispute arising out of or relating to the Program shall be resolved in accordance with the dispute-resolution provisions of our website terms.
